Jeff Kane represents plaintiffs in complex copyright and trademark infringement matters, often involving mass infringement. Jeff has successfully litigated lawsuits in virtually every procedural posture including complaint, motion to dismiss, discovery, settlement, jury and bench trial, appeal, and judgment collection. He has represented companies and individuals in civil and criminal matters involving copyright infringement, trademark infringement, fraud, breach of contract, breach of indenture, administrative law, government contracts, torts, bankruptcy, and professional liability. As a former Certified Public Accountant, Jeff often is called on to handle matters and arguments involving financial or accounting issues.
Prior to joining O+Z, Jeff was an associate at Robbins, Russell, Englert, Orseck, Untereiner & Sauber (now part of Herbert Smith Freehills Kramer) and a counsel at Akin Gump Strauss Hauer & Feld. Before entering private practice, Jeff clerked for Judge Richard G. Taranto of the U.S. Court of Appeals for the Federal Circuit, and for Judge Kevin McNulty of the U.S. District Court for the District of New Jersey.
Jeff received his J.D. from Yale Law School, where he and a co-counsel won the Potter Stewart Prize for Best Overall Written and Oral Argument in the school’s moot court competition.
Cengage v. Google
We are representing Cengage, Macmillan Learning, Elsevier, and McGraw Hill in a copyright and trademark infringement action against Google for its advertising of unauthorized, infringing copies of the Plaintiffs’ textbooks and educational works. (Southern District of New York)
- Spearheaded an argument in a breach of indenture action that the court used as one of two bases to award Jeff’s client $310 million after a bench trial in the U.S. District Court for the Southern District of New York.
- Drafted a Rule 5109 statement of position that persuaded the PCAOB not to pursue disciplinary proceedings against an auditor.
- Drafted key portion of a brief challenging the retroactive application of a U.S. Customs regulation restricting tariff refunds. The Court of International Trade invalidated the rule entirely.
- Obtained asylum in the United States for a former member of a political opposition party in Ethiopia. Handled expert report on political conditions, and prepared applicant for testimony.
- Conducted several fact depositions of senior executives and board members to successfully defended a major accounting firm against a civil suit alleging breach of contract and negligence.
